The Supreme Court in President Obama's Second Term
Jan 21st 2013, 19:57

Justice Scalia as Venetian doge.

If you watched the inauguration ceremonies, whether in person or on television, you may have noticed all nine Supreme Court justices out in force. Supreme fashions generated talk on Twitter, especially Justice Alito’s snazzy sunglasses and Justice Breyer and Justice Scalia’s jaunty skullcaps (discussed by Tony Mauro and Josh Blackman; according to Kevin Walsh, Justice Scalia’s was a gift from the St. Thomas More Society of Richmond, Virginia).

That’s on the level of style. What about substance? How will the Supreme Court affect President Obama, and how will President Obama affect the Court, as we enter the 44th president’s second term?

That was the subject of a HuffPost Live discussion that I participated in earlier this afternoon, featuring the following panelists (besides yours truly):

  • Mike Sacks, moderator;
  • Thomas Dupree, partner, Gibson Dunn & Crutcher;
  • Lisa McElroy, associate professor of law, Earle Mack School of Law at Drexel University;
  • Eric Segall, professor of law, Georgia State University College of Law.

Here’s the video, in which we discuss which justices might take their leave of SCOTUS, who might replace them, and what issues might appear before the Court during Obama’s second term:
